These terms govern your use of nearsmarter.com (the 'Site'). Engineering services purchased via NearSmarter are governed by a separate Master Services Agreement signed at engagement kickoff.
1. Acceptance
By accessing the Site, you agree to be bound by these terms. If you do not agree, please do not use the Site.
2. Permitted use
The Site is provided for informational purposes and to allow you to configure team estimates. You may use the calculator, share estimates and create an account to save your work.
You may not: scrape the Site at scale, attempt to reverse engineer it, use it to mislead third parties, or use it for any unlawful purpose.
3. Account responsibilities
You are responsible for the accuracy of information you submit, including company name, contact details and project briefings. You are also responsible for maintaining the confidentiality of any credentials.
4. Pricing & estimates
Rates and estimates displayed on the Site are indicative. Final pricing is established in a written proposal as part of contracting. Indicative prices may change without notice.
5. Intellectual property
The Site, its content and trademarks are the property of NearSmarter and Luby Software. Limited use for personal evaluation is permitted; redistribution is not.
6. Disclaimer & limitation of liability
The Site is provided 'as is' without warranties of any kind. To the maximum extent permitted by law, NearSmarter shall not be liable for any indirect, incidental or consequential damages arising from your use of the Site.
7. Governing law
These terms are governed by the laws of the State of Delaware, USA, and any disputes will be resolved in the courts of Delaware.
